Unbridled Racing Pty Ltd (ACN 617 122 951) (Unbridled Racing, We, Us, Our) provides products and services for the acquisition of fractional interests in thoroughbred racehorses.  


Unbridled Racing is committed to dealing transparently and fairly with the personal information we collect in connection with our thoroughbred racehorse fractional interest products and services and other operations. This policy outlines how we collect and manage your Personal Information. 


Unbridled Racing complies with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. We regularly review our practices and procedures regarding how we collect, hold, use, disclose and otherwise manage personal information. As a result, this policy may be updated from time to time. Where we update this policy, we will make the updated policy available, including on our website.  


1.  Personal and sensitive information 


1.1 What is Personal Information and why do we collect it? 
 
Personal Information
is information or an opinion that identifies an individual.  Examples of Personal Information we collect include: 

  • your basic details such as your name and date of birth;
  • your contact information such as your address, email address and phone number;  
  • your account and login details;  
  • information about your use of the Unbridled Racing website and applications, including browsing activity and interactions; and
  • if you are applying for or seeking to acquire the Unbridled Racing products:
    • your proof of identity, such as driver’s licence or passport details (for identity verification);
    • to comply with our obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and other similar laws;    
    • your financial information, such as your bank account details and information about your financial circumstances; and
    • your transaction information, such as details of your purchase. 


Where practicable to do so, we will generally collect your Personal Information only from you and directly from you (for example, from correspondence, by telephone, by email, via our website or through the Unbridled Racing applications).   
 
Where it is impractical or unreasonable to collect information directly from you, we may also collect information from other sources such as third party identity verification service providers, the responsible entity of the relevant racehorse ownership scheme (including Sire Custodians Ltd), or publicly available sources such as media publications or social media pages.  In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.    
 
Third parties will usually have their own privacy practices, as described in their privacy policies, which may differ from ours.  We don’t control third party websites or applications which may be linked on our website or applications and can’tguarantee how your Personal Information will be treated by such third parties. 
 
We collect your Personal Information primarily for the purpose of providing our thoroughbred racehorse fractional interest products and services to you.  Examples of these uses include: 

  • providing Unbridled Racing products and facilitating your acquisition of fractional interests in the racehorse ownership schemes relevant to the Unbridled Racing products;
  • managing your account and providing you with access to the Unbridled Racing website and applications;
  • using your bank account details to process and fulfil transactions for Unbridled Racing products;
  • using your contact information to respond to enquiries, send notices and information about our services and provide customer support; and
  • for regulatory or legal compliance purposes under laws such as the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).  Such purposes may include verifying your identity, confirming that you are old enough to access our services and maintaining records as required by law.   
     

We may also create anonymised data records from Personal Information we collect or hold in relation to you, for the purposes of analysing usage patterns or other aggregate data analysis to enhance our services and the Unbridled Racing applications. 

While you can refuse to provide us with Personal Information, we may not be able to provide you with some (or all) of our services without this information, and we may be limited in how we can interact with you. 
 
We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.  These may include: 

  • undertaking direct marketing (as detailed in section 2 below);
  • conducting statistical analysis to monitor, manage and report on the performance of our services and platform;
  • analysing and improving our services or potentially developing new products or services; and
  • security and cyber risk management. 


1.2 Sensitive Information 


We will not generally collect or hold sensitive information about you, unless we are required or authorised to do so by law. Sensitive information includes information about your race, political or religious beliefs, sexual preferences, criminal convictions, membership of professional or trade associations or unions or health information 


2. Marketing activities 


We may use or disclose your Personal Information for the purposes of sending you direct marketing communications by email or SMS about our products and services, for example to notify you of opportunities, offers, products or services that may be of interest to you, including new Unbridled Racing products.  We will only do so in accordance with the Privacy Act and other applicable laws. 


Each of the marketing communications we send to you will include a mechanism by which you can request to stop receiving those communications in the future (for example, an ‘unsubscribe’ link at the bottom of an email).  Alternatively, you may also contact us in writing at any time with your request.  We will comply with your request as soon as reasonably practicable.  However, if you are receiving or have previously received services from us, we may still send you important administrative communications that are required for us to provide the services or in accordance with law.  


3. Cookies 


When you visit our website or access our other Unbridled Racing applications, we will generally leave a Cookie in the memory of your device.  ‘Cookies’ are very small files that store information about your visit to and use of a website (however, they cannot access and read the other files on your device). Most major commercial Internet sites use them, and they make your browsing more useful and less time-consuming, because they store information that is reusable each time you return to a website.  This information includes any website usage preferences you have chosen to share with us.  


Our website and the Unbridled Racing applications may use persistent Cookies to authenticate you as a user and display content that is relevant and specific to you.     the responsible entity of the relevant racehorse ownership scheme (including Sire Custodians Ltd);  
  • related companies of Unbridled Racing (such as subsidiaries or holding companies of Unbridled Racing);

  • payment processors for the purposes of processing transactions in connection with Unbridled Racing products;  
  • third parties who are considering acquiring or making an investment in Unbridled Racing;  
  • our professional advisers (including legal and accounting firms, auditors, consultants and other advisers); and
  • government or regulatory authorities where required by law. 

Unbridled Racing does not currently disclose personal information to recipients located overseas or have established plans to do so. If Unbridled Racing is likely to disclose personal information to recipients located overseas, Unbridled Racing will update this privacy policy regarding the likely disclosures (including, if it is practicable to do so, the countries in which such overseas recipients are likely to be located). 
 
5. Security of Personal Information 

We store your Personal Information in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.  For example, we ensure that:

 

  • your Personal Information is only accessible to our personnel who require access to the information to perform their duties and conduct our business;
  • our employees are trained about their obligations under this Privacy Policy and required to comply with our internal information security policies, which are regularly reviewed against industry-standard practices and our legal obligations; and

6.1 Anonymity and pseudonymity 


You may request to engage with us using a pseudonym or whilst remaining completely anonymous, including when you make inquiries with us or send us complaints or feedback.  We may be limited in our ability to engage with you if you request to use a pseudonym or remain anonymous. 


However, in many instances we will need your personal information in order to provide our services to you, and it may not be possible for us to provide you with our services (including processing an application for Unbridled Racing products or facilitating your participation in a racehorse ownership scheme) if you are engaging with us anonymously or using a pseudonym.   


6.2 Requests for access and correction 


You may access the Personal Information we hold about you and request that we update and/or correct it, subject to certain exceptions. If you wish to access or correct your Personal Information, please contact us in writing.  We will endeavour to respond to your request within 30 (thirty) days.  In the event we are unable to provide access or make the requested correction within the above timeframe, we will provide you with written reasons and suggest alternative approaches to address your concerns. 


Unbridled Racing will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information. 


In order to protect your Personal Information, we may require identification from you before releasing the requested information. 


6.3 Maintaining the quality of your Personal Information 


It is important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up to date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

We will acknowledge your complaint within 7 (seven) days of receipt and endeavour to resolve it within 30 (thirty) days, unless we inform you otherwise in writing. 


Following receipt of your complaint, we will commence an investigation and may require you to provide additional details.  To the extent lawful and practicable, we will deal with any complaints in a confidential matter.
